Terms of Service

These Terms are the agreement between you and Trampoline Software SRL for your use of Formspark. Using the service means you accept them.

The short version: keep your account secure, do not use Formspark for anything illegal or deceptive, and you own what your forms collect.

Your account

You must be at least 16 years old to have an account.
Keep your account secure. Do not share your sign-in link or let others use your account. We are not liable for loss that follows from someone else getting in.
You are responsible for everything posted under your account. That covers content submitted by others through any site that points at your forms.
Give us accurate information when you register, and keep it current.
Do not use a name that belongs to someone else, or that you have no right to use.

What you may not use Formspark for

You may not use the service to:

Break the law in your country or ours
Collect credentials, card numbers or wallet keys under a false identity
Impersonate another person, company or brand
Send unsolicited bulk email
Collect any of the data listed as off limits in our Privacy Policy, such as health data, criminal records or children's data
Get around the submission limits on your plan

Your content

What your forms collect is yours. We claim no ownership of it. We own the code, the databases and the service itself.

You give us the permission we need to run the service for you: to store your submissions, show them to you, forward them where you asked, and back them up. That permission covers nothing else and ends when the data does.

Changes to the service

We may change or withdraw parts of the service. Where a change would break how you use Formspark, we will give you notice before it lands.
We are not liable to you or anyone else for changing, suspending or withdrawing the service.

Payment

Purchases are one-time payments. We charge no recurring subscription fees and take no automatic payments.
A purchase applies to one workspace. Submission bundles do not expire and stay with the workspace they were bought for.
Features and capacity from an upgrade apply to that workspace only.
We may change prices and the contents of plans and bundles. Changes apply to future purchases and never to submissions you already bought.
Purchases come with a 30-day money-back guarantee. After that we refund only where the law requires it.
Payments are handled by Paddle, which acts as our merchant of record. Card numbers never reach our servers.

Closing your account

You can close your account yourself, from the account settings in the dashboard. It shows you exactly what will be removed before you confirm.
Closing it deletes the workspaces you own and every submission in them, straight away. That cannot be undone, so export anything you want to keep first.
If you are the only administrator of a workspace shared with other people, we ask you to hand it over first. Removing the last administrator would strand everyone else in it.
We keep two things afterwards. We keep your email address, so that closing and reopening an account cannot hand out a second free allowance. We keep the list of addresses that have unsubscribed from autoresponses, so an unsubscribe stays honoured.
We may suspend or close an account that breaks these Terms, or where the law requires it.

What we do not promise

You use the service at your own risk. It is provided as it is.

We give no warranty that it will be uninterrupted, secure, or available at any given moment. We do not warrant that every defect will be fixed, or that the results will meet your needs.

The material on our website may contain technical or typographic errors. We do not warrant that it is accurate, complete or current, and we may change it without notice.

Nothing here removes a right the law gives you and does not let us exclude. If you are a consumer in the EU, your statutory rights stand.

Limits on our liability

We are not liable for indirect, incidental, special or consequential loss. That includes lost profits, lost data, lost goodwill and other intangible loss, arising from:

Your use of the service, or your inability to use it
The conduct or content of any third party on the service
Any content you obtained through the service
Unauthorised access to or alteration of what you sent or stored with us

This limit does not apply to fraud, to death or personal injury caused by our negligence, or to anything else the law says we cannot exclude.

Governing law and disputes

The law of Belgium governs these Terms, without regard to its conflict of law rules.
Talk to us before going to court. Both sides should try to settle a dispute by discussion or mediation first. A mediator has to be one both sides accept.
Disputes are settled in Belgium, unless the law says otherwise. If you are a consumer, you keep the right to bring a claim where you live.
If we do not enforce a right, we have not given it up. If a court finds one clause unenforceable, the rest still stands.
These Terms, together with the Privacy Policy and the Data Processing Agreement, are the whole agreement between us about the service.

Changes to these Terms

We update these Terms when the service or the law changes. The effective date at the top tells you which version you are reading.

When a change matters to you, we tell you by email or by a notice in the dashboard before it takes effect. If you do not accept it, close your account before that date.

Small corrections, such as fixing a typo or a broken link, take effect when we post them.
